This document is published by the company PRIVIZE.IO, a simplified joint-stock company (SAS) with a capital of 100 euros, whose registered office is located at 25 rue de Ponthieu, 75008 Paris, registered with the Paris Trade and Companies Register under the number 988 989 919, VAT number FR20988989919 

(hereinafter referred to as "We" or "Privize.io"), as part of its commitments to its payment service partners who, via the Platform, offer payment solutions aimed at Creators.

This document applies to all users of the Privize.io platform, whether they are Creators, Buyers, or Mandataries (hereinafter referred to as "Users" or "You").  and complements the General Terms of Service and Use (CGSU) and the General Terms of Sale (CGV) that they must accept as part of their certification process.

Article 1 - Privize.io's Commitment to Preventing Illegal Content

Privize.io demonstrates a firm commitment to combating illegal content and any form of online violence while respecting the legal framework and its role as a host for content created and published by Creators. 

To this end, the Platform has established a rigorous and structured process to counter these contents, organized as follows:

Any User wishing to become a Creator on Privize.io must necessarily undergo certification, which includes the submission of an identity document and a real-time selfie. 

These elements are analyzed and validated by an artificial intelligence solution designed to minimize the risks of forgery, thus allowing Privize.io to accurately identify the author of any potentially illegal content and, if necessary, initiate appropriate legal actions.

Upon the upload of content by a Creator, a second artificial intelligence solution, developed in partnership with a third-party expert, conducts an automated analysis to detect any elements that may be considered illegal under the law or Privize.io's Content Charter. Any content identifying a prohibited element is immediately blocked and prevented from publication. 

Likewise, when a Creator includes multiple third parties in their content, Privize.io may require written evidence of their consent, such as a rights assignment for image use or a release authorization. 

In case of dispute or uncertainty during this pre-publication phase, the file is forwarded to a specialized moderation team for a thorough assessment.

After publication, Privize.io implements random checks, particularly to scrutinize content associated with transactions deemed "exceptional" or "abnormal". 

If content is recognized as manifestly illegal, it may be removed without delay. 

Furthermore, as a host, Privize.io commits to swiftly responding to any notification reporting potentially illegal content. 

Each published media has a reporting button that allows any user to submit a formal notification, which, if substantiated, can lead to the immediate removal of the concerned content.

Article 2 - Rules Applicable to Content Imported on Privize.io

To benefit from Privize.io's Services, you agree not to import and/or market on Privize.io content that:

shows, includes, or references:

• any person under the age of 18 (or containing general references to minors); or

• any other person unless you can provide evidence that all persons appearing, mentioned, or represented in your content are at least 18 years old, and that you have obtained their written consent allowing the use of their name and/or image in the content published on Privize.io.

• firearms, weapons, or any property whose sale, possession, or use is subject to prohibitions or restrictions;

• violence, rape, lack of consent, hypnosis, intoxication, sexual assault, torture, sadomasochistic abuse, or hardcore bondage, extreme fisting, or genital mutilation;

• necrophilia;

• urinary, scatological, or excrement-related material;

• "revenge porn" (that is, any sexually explicit material featuring a person who has not given their prior, express, and fully informed consent for such material to be (a) taken, captured, or otherwise recorded, or (b) published and shared on the platform);

• drugs or drug paraphernalia;

• A Private Media that does not conform to the description provided at the time of sale;

• self-harm or suicide;

• incest;

• bestiality;

• escort services, sex trafficking, pimping, or prostitution;

• contains unsolicited sexual content or unwanted sexual language directed at another user or any other person in a non-consensual manner; or presents falsified, manipulated, or fake sexual content involving another user or any other person (including "deepfake" type content);
  
  

• intentionally provokes or seeks to provoke emotional distress, discomfort, humiliation, or serious offense towards others, notably by disseminating intimate or sexual content without consent, such as those involved in "revenge porn" or any other form of invasion of privacy or dignity of a person;
  
  

• is used, or designed to be used, as a means of coercion or blackmail aimed at obtaining money, services, or any other advantage;
  
  

• explicitly or implicitly presents, encourages, or promotes statements or behaviors inciting hatred, rejection, or violence against a person or group, based on criteria such as skin color, origin, nationality, religion, gender, gender identity or expression, sexual orientation, age, disability, health status, social status, or any other protected characteristic. This type of content includes messages aimed at belittling, excluding, intimidating, or threatening, as well as any form of discriminatory propaganda or stigmatization.
  
  

• reveals, shares, or exploits without authorization personal or confidential information regarding a third party, regardless of its nature or purpose. This includes but is not limited to: private contact information (such as phone numbers, postal addresses, or geolocation), identification data (names, official documents, login credentials), banking or financial information (accounts, payment cards), email addresses, medical or biometric data, as well as any element that allows direct or indirect identification of a person.
  
  

• in the case of content exhibiting public nudity, recorded or broadcast from a country, state, or province where public nudity is illegal.
  
  

• when sexually explicit content is recorded or broadcast from a public place where uninvolved persons may reasonably be exposed to the scenes in question. Private or isolated outdoor spaces, such as a fenced yard or a remote area in nature, are excluded from this definition, as long as no third parties are present or likely to be present.
  
  

• propagating a computer virus or any other computer code, file, or program designed to gain unauthorized access to the Company's computer systems or disrupt, destroy, or limit the functionality of the Platform, or, more generally, any software or hardware or telecommunications equipment;

• negatively affecting the ability to use the Platform, by any means and particularly by sending an excessive amount of Content (flooding attack);
  
  

• contacting and/or collecting personal data from a User for commercial and/or illegal purposes;
  
  

• collecting or extracting data from the Platform for any purpose, including using automated means (such as spiders, bots, data mining tools);
  
  

• promoting any company, website, or competing platform of the Company;
  
  

• marketing products derived from the human body;
  
  

• offering, soliciting, or promoting sexual relationships involving financial compensation; prostitution and escort services are strictly prohibited on the Platform;
  
  

• communicating personal contact details, including phone number through a Private Media;
  
  

• altering the functionality of the Platform or exploiting a competing platform; using any or all elements of the trademark of Privize.io (name, logo, graphic charter…);
  
  

• has been generated, modified, or improved using artificial intelligence to represent a person other than the Creator or any real individual who has not expressly consented in writing to the Creator's exploitation of their image in this manner. The use of artificial intelligence is permitted exclusively to improve the Creator's own Private Media or to create models fully generated 100% by artificial intelligence.
  
  

•  has been generated, modified, or improved using artificial intelligence without being clearly identifiable or identified as such by any means, for example by indicating “virtual image” in the description or using the “#AI” badge in the content description.
  
  

• Content retrieved from the Internet, other platforms, or resulting from leaks or hacks;

If at least one of the conditions mentioned above is not respected, we reserve the right to take, without notice, appropriate measures.

• The immediate suspension of the account,
  
  

• The freeze of ongoing withdrawals,
  
  

• The permanent deletion of the affected contents,
  
  

• And, if necessary, a report to the competent authorities (especially in case of a criminal offense related to the right to image, privacy, or non-consensual dissemination of sexually explicit content).

  
  

Article 3 - Rules Applicable to Contents Created or Altered by Artificial Intelligence

We encourage innovation related to artificial intelligence, provided it respects everyone's rights, the General Terms of Service and Use (CGSU), the General Terms of Sale (CGV), and this charter. 

In this regard, concerning contents created, modified, or improved using a tool integrating an artificial intelligence solution, it is imperative that the following principles are strictly observed by all Users of the platform, and in particular by the Creators:

• It is strictly prohibited to publish content portraying a person, even a highly recognized one, unless they have provided written consent beforehand, when such content has been created or modified using artificial intelligence. 
  
  

• Only content generated 100% by artificial intelligence is allowed. No deepfake or modification of the image of a non-consenting person is tolerated on Privize.io.
  
  

• Any content generated, modified, or improved by artificial intelligence, when it represents a real person, must only be associated with a certified Creator or a third party who has entered into a formal written agreement with the said Creator affirming their majority, legal capacity, and explicit consent to the commercial exploitation of the content concerning them via Privize.io.
  
  

• Any Creator publishing content created, modified, or improved by an artificial intelligence solution is required to clearly indicate it, particularly by affixing the badge "AI Generated". When uploading a Private Media on Privize.io, you will have the option to select or not this badge, which will then be displayed prominently on your sales pages.

Any violation of these rules may lead to the immediate removal of the Content and/or the application of sanctions against the concerned Creator, in accordance with the General Terms of Services and Use and our current Content Charter.
